Tracy O’Brien out of business?

Back to the OP, I don't think they are out of business because not long ago the website updated with a lot of new parts. I was eyeing the Jab 3300 mount and gear legs to switch over from what my kit's original owner was planning (Jab 2200 tri-gear, I'm planning Jab 3300 taildragger) Most likely a seasonal thing. At least I hope so.

Waiver aside I think you’re assessment of TB’s business model is way off. It has nothing to do with avoiding liability. He makes an alternative set of parts that some of us feel offer better design/construction than the original bits. To me this made it worthwhile to purchase a few of his components as “upgrades”. That is why he gets business.

Maybe it maybe not your liability concerns are legitimate, but I think it’s a red herring anyway. In the real world there doesn’t seem to be any interest in suing anybody over the construction of experimental amateur built aircraft, so easier just to sign and move on.

My understanding of what you are signing is not just release of liability but that you are signing up for financial responsibility for a previous owner who decided to sell/gift a copy of their plans to a scratch builder. Sonex then has a right to compensation of however many copies were distributed. Does this sound reasonable given that you have no way of knowing the sins of previous owners?

I will never purchase anything from Tracy O'Brien again. I had such a terrible experience with his Jab 3300 T/D mount which was not built to Sonex plan specs. He refuses to make it right. I normally don't speak ill of others, but I hope he's not able to provide sub-standard aircraft parts in the future.
